ARCATA FIRE PROTECTION DISTRICT NOTICE OF ADOPTION OF ORDINANCE 15-16 AND ATTACHMENT

NOTICE IS HEREBY GIVEN that on Tuesday May 19, 2015, June 16, 2015 and Friday June 19, 2015 the Board of Directors of the Arcata Fire Protection District took public comment during their regular and special Board meetings to hear input from the public regarding Ordinance No. 15/16, an ordinance of the Arcata Fire Protection District proposing uniform schedules and rates for a special tax for fire protection and prevention services including Schedule B . Motion was made to adopt Ordinance 15-16 including Attachment B, and seconded and passed unanimously with a roll call vote by the following: Aye: Directors Davis, David, Tyler, Lindstrom and Sundberg on June 19, 2015. The purpose of the adoption of Ordinance No. 15-16 is to provide funding for the purpose of obtaining, furnishing, operating, and maintaining fire suppression equipment or apparatus, for paying the salaries and benefits to firefighting personnel, and for such other necessary fire protection and prevention expenses of the District. Summary of Ordinance 15-16 1. In accordance with Section 53978 of the California Government Code, a special tax for fire protection and prevention services is proposed for the purpose of obtaining, furnishing, operating and maintaining fire suppression equipment or apparatus, for paying the salaries and benefits to firefighting personnel, and for such other necessary fire protection and prevention expenses of the District. 2. The ordinance proposed by the Board, must, by law, be submitted to the qualified voters of the district, whose approval by a two-thirds vote of those casting ballots is required if the tax is to become effective. The Board of Directors of the Arcata Fire Protection District hereby call for a special election to be held on November 3, 2015 for this purpose. 3. The special taxes shall be collected in the same manner and subject to the same penalty as, or with, other charges and taxes fixed and collected by Humboldt County on behalf of the District and the County may deduct its reasonable costs incurred for such service before remittal of the balance to the District. 4. Each Unit of special tax shall not exceed $24.00 each year and shall be calculated as shown in Schedule "B" hereto, incorporated herein. 5. A unit or multiple units of special tax shall be levied on a use of property basis except for property belonging to federal, state or local government agencies. 6. If any section, subsection, sentence, phrase or clause of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of the Ordinance. The Board of Directors of the Arcata Fire Protection District here declare that they would have adopted the Ordinance and each section despite the fact that one or more sections, subsection, phrases or clauses be declared invalid. 7. Each property owner in the District shall, within thirty (30) days after mailing of the notice of the special tax bill for that fiscal year, have the right to file a written appeal with the District protesting the levy of such special tax. The filing of an appeal is not grounds for failing to timely pay the entire amount of taxes specified as due on the tax bill. If the special tax is either reduced or increased as a result of the decision by the Board of Directors, the amount of the special tax shall either be refunded or increased. The property owner, or their designated representative may be present at the protest hearing concerning the setting of the special tax rate. 8. The Board of Directors of the Arcata Fire Protection District are empowered and authorized to adopt Ordinance 15-16 upon its confirmation by the voters in the District at the special election of November 3, 2015. Full copies of Ordinance 15-16 and attachment 'B" are available for public inspection at the temporary Headquarters Station of Arcata Fire Protection District at 905 6th Street, Arcata, CA 95521, between the hours of 9:00 a.m. and 3:00 p.m. Monday through Friday.
